Most mediations consist of two to four sessions spread over a few weeks. That is considerably shorter than court proceedings, which easily take months or years.
Yes. Confidentiality is one of the core agreements and is recorded in the mediation agreement. What is discussed at the table stays at the table and cannot later be used in proceedings.
No. Mediation is voluntary. Both parties take part because they want to, and anyone can end the process at any moment. Only once there is agreement are the terms recorded as binding.
That can happen, and it is not a failure. You are not left in a weaker position: everything discussed at the table stays confidential and cannot be used in proceedings. Often part of the issues have been settled, leaving a smaller and clearer dispute. If you still cannot agree, the route to court or a disputes committee remains fully open.
At a neutral location, agreed with both parties. I work from Zevenhuizen and am available throughout the Netherlands. Online mediation by video call is also possible, for instance when parties live far apart or travelling is difficult.
